In the wake of child fatalities attributed to a tainted cough syrup in Madhya Pradesh, the Indian Medical Association (IMA) is demanding the Union Health Minister’s urgent action to withdraw the case against the arrested pediatrician. The IMA unequivocally condemns the action taken against the registered medical practitioner, asserting that the root cause of the tragedy stems from the manufacturer’s substandard quality control and systemic failures in regulatory oversight.
The association’s letter to the Health Minister clearly places the legal culpability for distributing an adulterated drug on the manufacturer and the responsible enforcement agencies. The IMA views the pediatrician as a secondary victim of this systemic collapse and calls for the immediate cessation of all legal proceedings, citing professional defamation and trauma.
The IMA President underscored that the arrest violates established Supreme Court guidelines for apprehending doctors. Physicians, he explained, prescribe approved drugs without the means to verify potential manufacturing flaws or hidden toxic substances such as Diethylene Glycol. Blaming the prescribing doctor for an undetected defect in drug formulation shifts accountability away from where it truly belongs – outside the clinical practice itself.
The IMA outlined potential consequences, including a rise in defensive medical practices and a hesitancy to prescribe cost-effective generic medications, which would ultimately disadvantage patients. To bolster drug safety nationwide, the IMA advocates for enhanced regulatory capacity, mandatory contaminant testing, a proactive drug recall system, improved pharmacovigilance, and targeted inspections. The association stands ready to partner with the Ministry in enacting these vital reforms.
