Bilaspur. The Chhattisgarh High Court has stayed the transfer to the severe Naxal -affected district (Sukma) of the injured jawan in the Naxalite attack. Constable Dinesh Ogre was shot in Bijapur in 2016. He had an accident in 2018, due to which he had a steel rod on his leg. After which he challenged the transfer in the High Court citing DGP circular. While giving the verdict in the case, the High Court has stayed the transfer and relieving order.
In fact, Dinesh Ogre, a resident of village Nagarada, District-Sarangar, was posted as constable in the second battalion, Chhattisgarh Armed Forces Sakri. During this time, the second corps of the army issued an order and transferred Dinesh Ogre to F Company Sukma. After which he challenged the transfer order by filing a writ petition in the Bilaspur High Court.
Dinesh Ogre’s lawyer presented the argument of the High Court, saying that, in 2016, the petitioner Pamde was posted as a constable in District-Bijapur. The petitioner was shot in the head of the Naxalites during the helipad security. Due to which he was seriously injured. Along with this, due to the accident of the petitioner in the year 2018, there is a steel rod in his left leg.
High court set up stay
The jawan’s lawyer had said in the High Court that, the jawan has difficulty in walking due to the injured and crash. Since the district-cum is a very sensitive and gross Naxalite district, since the physical and mental state of the applicant is not eligible to serve in the gross Naxalite district. If the petitioner joins the Ghor Naxalite district-sukma, the petitioner’s life is threatened by the Naxalites being in the target. At the same time, after hearing the writ petition, the Bilaspur High Court has put a stay on the transfer order and relieving order of the petitioner for the district-sukma.
