Growing frustration is evident among tribal and indigenous communities regarding the Jharkhand government’s failure to enact the PESA law. Vijay Shankar Nayak, a prominent leader of the Tribal–Indigenous Rights Forum, voiced his deep concern, asserting that PESA is intrinsically linked to the very survival and autonomy of Jharkhand’s social fabric. He pointed out that the government’s indecisiveness is perceived as a direct threat to the established authority of village councils (Gram Sabhas). Nayak posed a direct challenge, asking, ‘The public wants to know who is pressuring the government.’ He further elaborated that the impact of PESA would be most acutely felt in areas targeted for mining and land acquisition, leading to widespread suspicion that corporate interests are influencing the government’s reluctance to proceed. The government is urged to be transparent about these alleged pressures.
Nayak lamented the current lack of empowerment for Gram Sabhas. Despite ministerial statements, the crucial PESA implementation notification remains unissued. Furthermore, the rules governing Gram Sabha empowerment and the precise functions of grassroots panchayats are unclear, creating significant uncertainty among the populace. This dilatory approach, he suggested, seems designed to obstruct, rather than facilitate, the transfer of constitutional rights to local self-governance bodies. ‘If PESA isn’t implemented, the crisis of existence will escalate,’ he stated.
According to Nayak, PESA represents not just development but a fight for survival for Jharkhand’s indigenous communities. Without it, land will be usurped, minerals will be exploited externally, and the local population will be further marginalized. He issued a stark warning of escalating displacement and accelerated resource exploitation if the government continues its inaction. He stressed the urgency, conveying a ‘now or never’ message. As the government’s current term progresses, Nayak highlighted the significance of this period for fulfilling the aspirations of Jharkhand’s people. He demanded a definitive announcement of the PESA implementation timeline, ideally by November 28, 2025, or shortly thereafter. The forum is prepared to mobilize a state-wide agitation if the government’s silence persists, signaling that the public’s patience has run out.
