Home Minister Amit Shah accused the opposition of seeking to establish a system where they can govern from prison. The remark was made in response to the opposition’s reaction to the 130th Constitutional Amendment Bill. Shah suggested that the opposition is looking to turn jails into places from which they can run the country, with key government figures taking instructions from behind bars. Shah made these allegations during an interview with ANI, where he extensively discussed the “The Constitution (One Hundred and Thirtieth Amendment) Bill.”
“Even today, they are trying that if they ever go to jail, they will easily form the government from jail. The jail will be made CM House, PM House and the DGP, Chief Secretary, Cabinet Secretary or Home Secretary will take orders from the jail,” said the Home Minister. He further expressed his belief that the bill will be successfully passed in the Parliament. Shah anticipated support from various factions within the Congress party and the wider opposition, citing moral considerations. The Constitutional Amendment Bill was introduced alongside the Union Territories (Amendment) Bill, 2025, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2025, during the Parliament Monsoon Session. The 130th Constitutional Amendment Bill specifically aims to prevent individuals in significant constitutional positions, including Prime Ministers, Chief Ministers, and Ministers, from exercising their governmental duties while imprisoned. This bill also includes a provision that allows an arrested politician to apply for bail within 30 days. If bail is not granted, the individual would be removed from their position or be legally disqualified after a 30-day period. However, if bail is secured later, they may resume their role.
